1. About these terms
These Terms of Service apply when you access HouseWorthy, purchase a report or report credit, upload documents or use a HouseWorthy Property Certificate. By using the service, you agree to these terms.
2. Nature of the service
HouseWorthy is a preliminary property-information and buyer due-diligence resource. It compiles and explains available public, official, third-party and customer-supplied information. Results vary by property and source.
3. What the service is not
HouseWorthy is not a title search, survey, valuation, legal or financial advice, planning advice, engineering assessment, compliance audit, building approval, certification, warranty, guarantee, or physical building and timber pest inspection. It does not predict future events, concealed conditions or future performance.
4. Property and data matching
You must review and confirm that the returned address and property are the intended subject. Property boundaries, ownership, easements, covenants, encumbrances, approvals and registered interests must be confirmed through current authoritative documents where relevant.
5. Uploaded documents
You confirm that you are authorised to upload and process each document. You must not upload unlawful material, malicious files, unrelated personal information or documents you are prohibited from using. Summaries do not replace the originating document, and the original document remains controlling.
6. Condition information and third-party inspections
HouseWorthy does not perform physical property inspections, and online property data does not establish physical condition. Condition findings are limited to observable matters recorded in a report produced by a separate third-party inspection company. Premise Inspections may be engaged separately for a pre-purchase or pre-sale inspection. HouseWorthy does not alter, independently verify or expand the inspection report’s scope, findings or limitations and does not assess concealed areas.
7. Property Certificate
The HouseWorthy Property Certificate is a dated record of searches completed, documents considered, reported outcomes and outstanding actions. It may be prepared for or shared by a buyer, seller or owner. It is not Queensland Form 2, a substitute for any seller disclosure obligation, a statutory certificate, approval, warranty, guarantee or declaration that the property is safe, compliant, structurally adequate, free from defects or suitable for purchase. Information and condition may change after the issue date.
8. Prices and payment
Prices are displayed in Australian dollars and include GST where applicable. Payments are processed by Stripe under its terms. A purchase is not fulfilled merely because a success page is displayed; access is provided after payment is verified by HouseWorthy’s payment records.
9. Report credits
A single-property credit applies to one property address. A three-report package provides three credits for different property reports and expires 90 days after purchase unless otherwise stated at checkout. Credits are personal and must not be resold, shared publicly or used for bulk commercial extraction.
10. Premise Inspections discount
A purchaser of a HouseWorthy Complete Report or Buyer Shortlist who books and completes a combined building and timber pest inspection with Premise Inspections for the same property within 30 days of the HouseWorthy purchase may receive $50 off the inspection price. The purchase email or Stripe receipt must be supplied when booking. One $50 discount applies per inspected property. The discount is not redeemable for cash, cannot exceed the inspection amount payable, cannot be combined with another inspection discount unless agreed, and applies only after the inspection is completed and paid in accordance with the booking terms.
11. Refunds and service availability
Refunds are handled under the published Refund and Cancellation Policy and Australian Consumer Law. If the HouseWorthy purchase has been refunded, charged back or otherwise reversed, no inspection discount applies. The service may be temporarily unavailable for maintenance, source outages, security issues or events outside reasonable control.
12. Acceptable use
You must not scrape, reverse engineer, circumvent access controls, probe the service, automate bulk searches without permission, infringe intellectual property, misuse personal information or use results for unlawful direct marketing.
13. Intellectual property and permitted use
Subject to payment and these terms, you may use a purchased report for your personal property due diligence and share it privately with your professional advisers. HouseWorthy branding, software, report design and explanatory content remain protected.
14. Consumer rights and liability
Nothing in these terms excludes rights or remedies that cannot lawfully be excluded under Australian Consumer Law. To the extent permitted by law, HouseWorthy is not responsible for decisions made without obtaining appropriate independent confirmation or for inaccuracies originating from third-party or customer-supplied information.
15. Governing law
These terms are governed by the laws of Queensland, Australia. Courts and tribunals with jurisdiction in Queensland may hear disputes.
